COBRA/HIPPA
Consolidated Omnibus Budget Reconciliation Act (COBRA)
Federal regulations require employers with twenty or more employees to comply with the provisions of Federal COBRA. California legislation regulates Cal COBRA for employers with 2-20 employees.
Trademark Insurance Marketing, Inc. will provide, AT NO COST for our clients, the following:
- Mail the initial "Model Notice" of COBRA rights to all eligible employees at their home address. A notice will be mailed to each employee and insured spouse.
- Mail, via Certificate of Mailing, to each qualified beneficiary notifying them of their eligibility for continued benefits within fourteen days of recieving the qualifiying event notice.
- Notify qualified beneficiaries of their conversion rights
- Notify those who have elected to continue coverage under COBRA of any premium, benefit or plan changes as they occur and also notify them of their rights as any new qualifying event occurs.
- Trademark will do billing (via coupons) and will be collecting all premiums due from all COBRA participants that we administer. The two percent administration fee, as allowed by Federal Law, will be added to all the base rates for Federal COBRA.
- Notify those who have elected to continue coverage under COBRA of termination in the event that premium payments are not received within the time frame stipulated by law.
- Maintain complete documentation of all eligible participants to show the IRS and DOC a "food faith" effort was made to comply with COBRA law.

- Provide certificates of coverage to comply with HIPAA for our COBRA clients
